Terms of Service

These Terms of Service ("Terms") govern access to and use of AppMetricsKit (the "Service"), a mobile analytics service operated by AppSurge in Belgium. By creating an account, accepting an invitation, or using the Service, you agree to these Terms. If you use the Service for an organization, you confirm that you are authorized to accept these Terms for that organization.

1. The Service

AppMetricsKit provides SDKs, an ingest API, dashboards, funnels, retention reports, subscription analytics, privacy findings, and export tools for mobile applications. Features may vary by plan. The Service is intended for developers, companies, and agencies that build or operate mobile applications.

2. Accounts and organizations

You must provide accurate account information and keep credentials, ingest keys, API keys, and recovery methods secure. You are responsible for activity performed by your organization members and integrations. Organization roles control access, but you remain responsible for granting and removing access appropriately.

3. Customer data and privacy

You retain ownership of data submitted to the Service. You instruct us to process that data only as needed to provide, secure, support, and maintain the Service. You are responsible for obtaining any required consent, providing notices to your app users, and ensuring that your use of AppMetricsKit complies with applicable law. Our data handling is described in the Privacy Policy and Data Processing Agreement.

4. Acceptable use

• Do not intentionally send raw account identifiers, advertising identifiers, names, email addresses, phone numbers, precise location, payment card data, or special category data in analytics payloads.
• Do not attempt to identify or reidentify pseudonymous app users.
• Do not bypass security controls, rate limits, or plan limits.
• Do not interfere with the Service or use it for unlawful activity.
• Do not upload malicious code or use the Service to infringe the rights of another person.

5. Plans, usage, and billing

Paid plans are monthly subscriptions charged at the price and in the currency shown during checkout. Applicable taxes may be added. Free and Indie stop accepting non-test production events after the monthly limit. Growth and Scale use soft limits and may continue accepting events above their included volume. AppMetricsKit does not currently add automatic metered overage charges unless a separate order or checkout clearly states otherwise. We will disclose any future overage price before it applies.

Subscriptions renew automatically until canceled. You can cancel through the Customer Portal, and cancellation normally takes effect at the end of the current billing period. Fees are nonrefundable except where required by law or stated otherwise during checkout. Failed or overdue payments may result in restricted access or suspension.

6. Third-party services

The Service can connect to third-party products such as identity, payment, and subscription revenue providers. Your use of those products is governed by their own terms. You are responsible for configuring integrations and keeping integration credentials current. We are not responsible for a third-party service outside our control. Providers appointed by AppMetricsKit are listed on the subprocessor page.

7. Service availability and changes

We operate the Service on a best-effort basis. No service level agreement applies unless agreed in writing. We may change, limit, or discontinue features. When a change materially reduces paid functionality, we will provide reasonable notice when practical.

8. Suspension and termination

You may stop using the Service or cancel a paid subscription at any time. We may suspend or terminate access for a material breach, security risk, unlawful activity, or overdue payment. Export data you need before deleting an app, organization, or account. After termination, data is deleted according to configured retention, operational deletion schedules, and legal recordkeeping requirements.

9. Warranties

To the extent permitted by law, the Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or suitable for every legal or business requirement. Privacy guardrails reduce risk but do not replace your own review of event payloads and disclosures.

10. Limitation of liability

To the maximum extent permitted by law, AppMetricsKit is not liable for indirect, incidental, special, or consequential damages, loss of profit, loss of business, or loss of data arising from use of the Service. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Changes to these Terms

We may update these Terms as the Service or applicable law changes. Material changes will be communicated by email or an in-app notice when appropriate. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.

12. Governing law and contact

These Terms are governed by Belgian law, without regard to conflict of law rules. Mandatory consumer protections in your country remain unaffected. Questions about these Terms can be sent to support@appmetricskit.com.
